Not So Flyable Heart

Despite having instituted a ban on Japanese IP addresses, the TLWiki apparently receives yet another cease and desist email, this time from SOFTPAL Inc. regarding the newly-started Flyable Heart project on the wiki. This resulted in the prompt deletion of the main project page from the wiki. Currently it is not clear whether that particular project will continue outside of the wiki. However, there is another project for Flyable Heart that appears to still be going, with project files on a REtrans site and discussions on 4chan.

The email received is quoted below:

貴サイト「http://tlwiki.tsukuru.info/index.php?title=Flyable_Heart」にて行われております、
弊社製品「Flyable Heart」の英文化は、著作権権利者である弊社は一切認めておりません。

即時、開発と公開の停止をお願いいたします。

The following is a translation:

    They have the legalese disclaimer in Japanese on the front page. However, they ban Japanese IPs. However, they apparently would still comply with any C&Ds that would make it through somehow.

    Their behavior is just so inconsistent it’s like cognitive dissonance illustrated. Just decide on one or the other already, for god’s sake.

    I believe TLWiki staff have stated that the only reason they comply with C&Ds is to prevent the webhost from liability. As for the legalese, that’s so communiques don’t get sent to random project e-mails nobody checks and get inadvertently ignored (as the eden* C&D originally was.)

    No one wants more C&Ds, so there’s nothing inconsistent about making it more difficult for Japanese companies to access TLWiki, while at the same time not ignoring their threats once made and risking legal action against the host.
