Kara no Shoujo and Cartagra projects C&Ded by copyright owners

May 6th, 2010, by zalas
Posted in Translation , Tagged: , ,

According to recent changes on the TLWiki, Gungnir, parent company to the eroge brand Innocent Grey, has requested that translation work on their games Cartagra and Kara no Shoujo be stopped and the removal of all relevant scripts and images via an email to the wiki’s site maintainer. The six-month-old translation project for Kara no Shoujo needed more editing and hacking for it to be complete, while Cartagra was a newly started project by the same translator. According to a post on 4chan, the project intends to move forward, just underground.

Here is a translation of said email:

This is Gungnir Ltd.

As the copyright holder, we request the following:
Please immediately stop translating our games Kara no Shoujo and Cartagra.
Please remove all relevant text, images, etc. from your website as well.

We look forward to your cooperation.

This is so twisted. Do manga authors write to scanlation groups to stop translating their manga? I don’t think so. And many of that manga is actually being officially translated into english. This is really nothing else than a message to filthy gaijin to put our hands off their sacred eroge.

Actually, something similar has happened once before, although I don’t know if it was the mangaka or the publishing company who started it. I believe it was a C&D to SnoopyCool.

Not really, Moogy’s a smart badass (He aids the translations in going underground while blocking Japanese IPs: he smiles at their faces while stabbing them in their collective backs.), while NNL is a bunch of Kamina-type badasses (They give Minori the middle finger without even trying to negotiate or putting up the illusion of compliance, ALL WHILE calling themselves “The ultimate Minori fanboys” JUST to piss the company off).
    Both are awesome.

Unless he Moogy publicly assures people that these translations are actually going to continue, then for all we know, it’s finished. A badass doesn’t try to look like he’s responding to his opponent’s wishes while slipping something out of his pocket in secret, he actually actively resists and makes it known.

Badassery is gauged above ground, not underground.

Really? Is there really anything wrong with him protecting himself from lawsuits from three companies while still helping to release the translations to the public?
Though you may be right about him not being a badass, he definitely is not a “Pussy King” like 6 said either.
And honestly, I don’t believe that actively antagonizing the companies like what NNL is doing is very smart. Moogy is probably making the better decision overall by aiding the underground projects rather than by giving the companies a big FUCK YOU! sign.
And I’m pretty sure that he made a post somewhere about aiding the translations in going underground. Can’t remember exactly where it was though…
The simple fact of the matter is that in the real world badassery=idiocy, and Moogy is making the smart decision in this case.

Unless one of them actually gets into a lawsuit, don’t try to pull that “lawsuit” crap. The companies are in no position to waste their time and money getting into a lawsuit with a foreign entity because they lack the resources to even bother doing so.

    >>29
What 28 said is true. The eroge companies (especially the smaller ones) don’t have the time or the resource to open a foreign lawsuit (mostly the funding). So all those talk about lawsuit is just a big excuse.

AQZT, I name you a fucking idiot. Congratulations.

  33. AQZT Says:
    May 7th, 2010 at 5:11 pm

    >>30
Okay. So ONE eroge company does not have the resources to open a lawsuit overseas. But what if, hypothetically, from the beginning, Moogy had given the companies the middle finger and refused to remove the projects? What if multiple companies worked together to get Moogy sued?
I’ll be the first to admit that it’s not too likely that it would happen, but as long as the possibility exists, I find it hard to criticize him as long as I’m not in the line of fire myself. Plus, KnS is still being released with Moogy’s help and blessings, so what is there to complain about?

  34. AQZT Says:
    May 7th, 2010 at 5:54 pm

Almost forgot to mention, but, think about this chain of events for a second:
-Rapelay gets brought up again in America
-Japanese Companies get scared that another fiasco like the previous one will occur, endangering their ways of life
-They then find that their games are being translated into English and get scared that American politicians will now start attacking the Japanese Eroge manufacturers
-Thus, their logical conclusion is to GET THEIR GAMES OUTTA THERE. To that end they send Moogy and NNL e-mails requesting that the patches for their games be taken off their websites, their line of reasoning being that if the patches are removed, that no one will want to buy the eroge being sold in the USA and then they will be safe.
In conclusion, these people are SCARED that their livelihoods are in danger. They aren’t being assholes because they hate us “Filthy Gaijins”, they just don’t want to get in trouble themselves.
Next, bringing this line of thought to tie back in with the whole “Lawsuit” thing.
Let’s pretend that Moogy decided NOT to remove the games from his website and instead told the companies to stfu.
Let me ask you: If you were the eroge companies, presented with this situation would you
    a) Not do anything, given the risk that the American government might start pressuring the Japanese government to place heavy restrictions on the eroge industry
    or:
    b) Work together to sue one lone man overseas to get your translations removed, thus removing the risk that American companies will screw you over?

The choice seems pretty obvious to me.
NOW do you understand my rationale for declaring that there may be a possibility that he’d get sued?

I’m completely new to the VN scene but from what I gather:

    1) Minori didn’t seem to get along with foreign countries
    2) The Rapelay incident occured
    3) Minori uses to incident to justify blocking foreign IPs
    4) Minori discovers TLwiki and possibly alerts other VN companies and urges them to send C&D letters to reduce the change of another Rapelay incident

Does this mean the main root of the problem lies in the American reaction towards Rapelay?

I found this letter mildly amusing. The US really shouldn’t have stuck their noses where it didn’t belong.

It’s a shame Minori doesn’t seem to accept us. I love ef and eden* (at this rate, it looks like only the demo will be translated…) but I can’t say much for their attitude.

Looks like you still don’t get it.
    I’ll explain:
My point in this argument, from the very beginning was not to provide PROOF that Moogy would get sued if he didn’t remove the files, but rather to show that Moogy had a REASONABLE FEAR that he might get sued by the companies if he didn’t remove them.
In post 30, you said that any fear that Moogy had of getting sued was invalid and unjustified. Thus, I gave you a hypothetical scenario under which Moogy very well MAY have been sued had he not removed the scripts, which established a reasonable fear of a lawsuit, and therefore gave him a reasonable justification to stop hosting the projects.
If you want to argue against me, please give me a hypothetical scenario of your own which contradicts mine, or point out a part of my scenario where my logic is flawed. Otherwise, just shut up.
    As for this:
“Also, if Moogy DOES release KnS, he’s a hypocrite.”
    Wow, just wow.

Yeah, I tought as much. Sadly not all people is smart enough to see that, and also not all politicians are smart enough to see that in (most of) the cases, these VN’s are harmless (of course, this doesn’t apply if you’re under 18, you horny teenager).
On the topic, there’s a reason why Australia is so f’cked up with its games’ rating system, and the reason why what minori said about releasing games in english would only work in (ironically) the ESRB’s system (It’s the only one I can think of where an adult VN has been clasified, IIRC, other clasification systems would refuse to rate them)
While the situation’s getting bothersome, we must try to think with a cool head and think about the other side of the situation here. However, this obviously doesn’t mean that I want every single translator to agree to what the companies have been doing =/.

First of all, can you explain something? I really can’t see the reason for the sheer amount of profanity that you are using in your posts. I don’t ever remember trying to piss you off THAT much, so could you please explain why you’re so angry?
Just to clarify, you are not offending my “delicate sensibilities” by doing this, nor are you succeeding in pissing me off, so I’d appreciate it if you could formulate a post where you aren’t cursing every other sentence.

    >>Indeed very reasonable. Well let’s see I’ll give you an example of my own, how about what minori is fucking doing right now after NNL released a full standalone patch. Exactly, JACK SHIT. Hope that lawsuit comes in soon because I’m dying to see your hypothetical reasoning prove me wrong. Remember all your reasons are hypothetical. Look at the present and see how your fucking hypothesis is so far. What’s true and what’s not true.

I actually predicted you were going to bring something like this up, so I’ll explain why NNL and Moogy’s cases are different:
NNL hosts projects from only one company: Minori, and by your own admission, a single company does NOT have the resources to sue overseas.
On the other hand, TLWiki hosts projects from several different companies, which means that there is a possibility of these companies coming together to sue Moogy. Them pooling their resources WOULD allow them to sue him overseas.

As you can (probably) see, Moogy’s situation and NNL’s situations in this case are not similar enough to really warrant a comparison. Now, what next? Remember, you are supposed to establish that Moogy had NO VALID FEAR of getting sued by the guys in Japan, not just write off the argument until a later date.

    As for this:
    >>NNL released a full standalone patch
    According to the NNL website:
“ef Lite released. Files are not available on this site.” -from http://nnl1.com/ef/

Which means that what they released on their website (I don’t know about the other places online) is only a PATCH for the game, NOT a standalone.

    >>No. Just no. You just don’t get it. I NEVER complained about whether he released the patch or not. Personally, I couldn’t give a rat’s ass about KnS since I didn’t even know the fucking game existed until this news post. It’s about ideal you dumb fuck. IDEAL. Great assumption there.

Thanks for clearing that up. I’ll apologize and retract my previous statement.

““What does Moogy have to do with anything? He’s never been part of the project, it was simply hosted on a site that he owned.

And if you didn’t notice already, he wasn’t the one who took down the project. Translator did.”

Actually, I’ll have to agree with you here. I was NEVER under the impression that the translator was the one who made the decision to remove KnS from TLWiki. Could you perhaps provide us with a source for where you found that piece of information?

Sorry, unmoderating some comments displaced the number order and I forgot to fix those. If your comment gets moderated, post one without links in it so I can just delete the moderated comment instead of having to renumber everything (or use usernames)

“First of all, can you explain something? I really can’t see the reason for the sheer amount of profanity that you are using in your posts. I don’t ever remember trying to piss you off THAT much, so could you please explain why you’re so angry?

Just to clarify, you are not offending my “delicate sensibilities” by doing this, nor are you succeeding in pissing me off, so I’d appreciate it if you could formulate a post where you aren’t cursing every other sentence.”

First off, fuck you if you don’t like how I speak. I like cursing and just because I curse a lot don’t mean I’m not making a valid point. Oh and for the record I’m not pissed at all. I made a post before on this site stating why I curse, but that’s just the way I talk. If you’re offended in any way…well I couldn’t give a shit.

“I actually predicted you were going to bring something like this up, so I’ll explain why NNL and Moogy’s cases are different:

NNL hosts projects from only one company: Minori, and by your own admission, a single company does NOT have the resources to sue overseas.

On the other hand, TLWiki hosts projects from several different companies, which means that there is a possibility of these companies coming together to sue Moogy. Them pooling their resources WOULD allow them to sue him overseas.

As you can (probably) see, Moogy’s situation and NNL’s situations in this case are not similar enough to really warrant a comparison. Now, what next? Remember, you are supposed to establish that Moogy had NO VALID FEAR of getting sued by the guys in Japan, not just write off the argument until a later date.”

Valid point. Point taken and I understand your point. Still don’t believe that even if they did work together, they wouldn’t do shit, but I get what you’re trying to say. I guess this is just my opinion and could be subjective though.

“Which means that what they released on their website (I don’t know about the other places online) is only a PATCH for the game, NOT a standalone.”

Yeah, but they still released the data files for the FULL game, so that’s standalone. I don’t care if they released through their homepage or not, but the fact is that they released it.

“Thanks for clearing that up. I’ll apologize and retract my previous statement.”

    Thanks.

“Actually, I’ll have to agree with you here. I was NEVER under the impression that the translator was the one who made the decision to remove KnS from TLWiki. Could you perhaps provide us with a source for where you found that piece of information?”

Find out on your own whether it’s the truth or not.

Whatever, I’m out. I’m getting tried of all these long ass back and forth posts. It was fun while it lasted~

You weren’t really offending me. I really have nothing against you cursing, I was just afraid that you were taking this a bit TOO personally and getting too angry about what was, from the beginning, a purely inconsequential discussion.

“Valid point. Point taken and I understand your point. Still don’t believe that even if they did work together, they wouldn’t do shit, but I get what you’re trying to say. I guess this is just my opinion and could be subjective though.”

Yeah, personally, I think that the actual chances of it happening are rather slim too, but I just don’t think it’s fair to blame Moogy as long as the possibility of a lawsuit exists

“Find out on your own whether it’s the truth or not.”

Actually, that last part was addressed at the guy who posted the original comment (Vodka), not you.

“Whatever, I’m out. I’m getting tried of all these long ass back and forth posts. It was fun while it lasted~”

Agreed. It was fun at the beginning, but its started to become rather tedious recently, so I’ll sign off too.

    ~END~

I didn’t know Jump actually did that, but their tankoubon sales are over the roof top anyway. Unless they profit a lot more from their magazine sales? Thanks for the link.

Rumors on /jp/ point towards a dual release of Cartagra and Kara no Shoujo (as apparently, Cartagra is : 1. chrnologically prior to KnS, thus some characters carry over. 2. KnS endings would make more sense after play Cartagra.

Besides, Cartagra translation is going really fast (up to 33% now).

    So just be patient.
