Dark Translations gets in legal dance with Pixy-Soft

Nephrinn, translator for Dark Translations, has written a post about Pixy-Soft claiming infringement of their materials on Dark Translations’ website. Pixy-Soft is a product brand under Japanese company Infini-Brain (parent company of the Lilith brands) that produces direct-to-video erotic animation adaptations of many Lilith game titles, of which some of the original games have been translated unofficially by Dark Translations.

UPDATE: Nephrinn writes in a comment to his original post, claiming that it was a fake DMCA from a company that doesn’t represent Pixy-Soft.

UPDATE 2: Nephrinn talked about taking the site offline and eventually removed all mention of the Pixy-Soft situation from his blog. Currently, the entire site is offline.

UPDATE 3: Images, etc. have been taken down at the request of the host provider due to a DMCA notice.

    It looks like it has nothing to do with Pixy-Soft at all and that this company is trying to scam me. Fantastic.

    There’s a new comment from Neph that this was caused by someone who only pretended to be from Pixy. Anyway, this whole case is ridiculous.

    It seems his website was forcefully taken down on 4/19/10 probably by the aforementioned scammer.

    The site is indeed offline but let’s not make any assumptions until we know what is happening. In fact, Nephrinn mentioned he might take down the site himself to protect himself from the scammer.

    It was a DMCA take down as I expected. I’m going to get the site back up minus images/patches and decide where to go from there. The guy basically makes a living off of issuing DMCA notices on behalf of the adult industry (they think he’s some kind of savior). I just think it is a sad state of affairs when fan translations are being targeted for copyright infringement, but so be it. I’m consulting a lawyer for advice on what to do on Thursday.     I don’t think it matters if the notice is real or the work of a scammer ; that copyright “agreement” is quite a load of BS in my polite opinion, and many lobbies have been terrorizing the server providers with it so much that they’ll cower in fear any time they receive a request.

    I hope Nephrinn manages to get out of this unscathed, and hopefully he’ll be able to resume his activity.

    This whole affair is another proof that something intelligent needs to be done regarding copyright – instead of those money-laundering bills every country is passing those days.

    My developer is trying to convince me to move to .net from PHP.
